Copyright and DMCA
Discover is a library of quizzes published by students in the QuizAwesome app. We respect copyright and respond to notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). If you think a quiz in Discover copies your work without permission, send us a notice as described below.
Signed in to the app? You can also tap Report → Copyright on the quiz. That alerts our team, but it isn’t a legal notice: to have a quiz taken down for copyright, send the written notice below.
1. Send a notice
Email dmca@quizawesome.com or write to the address in section 5. Your notice must include all of the following (17 U.S.C. § 512(c)(3)):
- Your physical or electronic signature (a typed full name is fine), as the copyright owner or a person authorised to act for them.
- The copyrighted work you say is infringed (for example the book title, edition and pages, or the test name). If one notice covers several works, a representative list.
- The quiz you say infringes, and enough to find it: its title, subject and level, and the creator’s display name exactly as Discover shows them. A screenshot helps. Tell us which questions copy your work.
- Your name, postal address, phone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
A notice missing any of these may not be valid, and we may ask you to complete it. Knowingly claiming that material infringes when it doesn’t can make you liable for damages (17 U.S.C. § 512(f)). Think first about whether the use could be fair use.
This page is for copyright. For anything else that breaks the law or our rules (for example harassment, personal information, or sexual or violent content), report the quiz in the app or email support@quizawesome.com.
2. What happens next
- We aim to act on a complete notice within 24 hours.
- If we uphold it, the quiz is taken down: it leaves Discover and is deleted from the library of everyone who downloaded it. Every other version the creator published from the same exam is taken down with it; together they count as one notice for section 4.
- The creator can’t publish that exam again until our team clears it.
- We tell the person who published it, with a copy of your notice, and how to send a counter-notice. [OWNER: lawyer: confirm we may share the claimant’s name and contact details with the creator, as is usual.]
- The creator’s own copy of the quiz in their Exams isn’t touched; only what was published is removed.
3. Counter-notice
If your quiz was taken down and you believe that was a mistake or misidentification, you can send a counter-notice to dmca@quizawesome.com or the address in section 5. It must include (17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- The quiz that was removed (its title as it appeared in Discover) and the date it was removed.
- A statement, under penalty of perjury, that you have a good faith belief the quiz was removed as a result of mistake or misidentification.
- Your name, postal address and phone number; a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district of your address (or, if your address is outside the United States, any judicial district in which we may be found); and that you will accept service of process from the person who sent the notice, or their agent.
If the law where you live requires another person’s consent for you to send a legal notice, ask the person legally able to consent for you to help you with a counter-notice. [OWNER: lawyer: counter-notices from people who can’t sign one alone.]
We send a valid counter-notice to the person who sent the notice. If they don’t tell us within 10 to 14 business days that they have filed a court action, the notice no longer counts against you (including for the policy in section 4), and our team clears the quiz so you can publish it again from your Exams. Until then, it can’t be published again. A taken-down quiz can’t be brought back as it was: publishing again starts a new listing, without the old downloads, likes, stars or stats. [OWNER: lawyer: confirm that letting the creator publish again meets the “replace the removed material” step of § 512(g)(2)(C).]
4. Repeat infringers
If 3 notices about different quizzes from the same person are upheld, that person can no longer publish to Discover, also with a new account using the same email address, and their other quizzes in Discover are hidden while our team reviews them. Versions published from the same exam count as one quiz. The ban stays until our team lifts it. A notice that is withdrawn, rejected or successfully countered doesn’t count. In appropriate cases we may also suspend the account under our Terms.
